Call for Proposal:  Engaging civil society in monitoring and reporting implementation of UPR recommendations in Moldova

Background:

Moldova went through the UPR in October 2011.  UN, and UNDP in particular, actively participated in the process engaging with the relevant Government and non-Government bodies, providing advice and necessary support, as through the on-going Human Rights work, so through the UNCT Human Rights Adviser. The Government accepted, as an initial matter, 107 out of 122 recommendations, reserving position on the remaining 15 for the March 2012 Human Rights Council.  The recommendations fall under the following general categories:

  • Anti-discrimination and anti-discrimination law
  • Rights of the child
  • Roma inclusion
  • Persons with disabilities
  • Rights of Women/Gender issues
  • Domestic violence
  • Rights of Stateless Persons
  • Human trafficking
  • Economic and Social Rights
  • Freedom of religion and belief
  • Language diversity
  • State language
  • National Human Rights Institution
  • Freedom of expression, assembly and association
  • Fight against torture, and ill-treatment
  • Judicial system
  • Detention condition
  • Events of April 2009
  • Civil society and UPR
  • Transnistria
  • Acceding to international instruments

With the support of UN Moldova, civil society was heavily involved in the UPR process. The UN supported consultation meetings involving Government, civil society and the National Human Rights Institution, organised a number of training workshops and two Study visits to Geneva (May 2010 and May 2011).  Civil society groups and Moldovan media attended the UPR Working Group session in October, and a number of civil society actors returned to Geneva for the March 2012 Human Rights Council meeting that adopted the UPR Moldova Working Group report.

Immediately after the UPR Working Group meeting in October 2011, UN Moldova supported a visit by the High Commissionner for Human Rights Navi Pillay, the first such visit by a High Commissioner.   The UN also worked closely with the Government to hold national-level consultations on the remaining 15 UPR recommendations, as well as to the structure of the follow-up actions.  In March 2012, the Government accepted most of the remaining recommendations.   The government intends to amend the National Human Rights Action Plan (NHRAP), adopted in July 2011, to incorporate the UPR recommendations.  A provision in this regard is included into the NHRAP.    UN Moldova is providing support to the Government's efforts in this regard by provision of the international and national expertisein the area.

The UPR recommendations are embedded in Moldova's new UN Partnerships Framework (UNPF) for 2013-2017; while the implementation of UPR recommendations is the core indicator for one of the UNPF Pillars.   UN Moldova has clustered the recommendations thematically for use by policy-makers, civil society, journalists and others.

There is a number of strongly positioned Human Rights NGOs in Moldova, that have certain capacity and experience in dealing as with Human Rights issues in general, so with the particular rights. They are addressing gender equality, rights of children, of the persons with disabilities, of minorities, other vulnerable groups, a wide range of political, civil, social, economic and cultural rights. Civil society is active in submitting shadow reports to the UN Human Rights Treaty bodies.

A certain segment of  these organisations became aware and trained on UPR issues benefitting from UNDP support and many  Human Rights NGOs continue advocacy activities related to the implementation of the UPR recommendations, promoting the messages on the importance of their implementation for Moldova through mass-media and other means, in particular, on such sensitive, but important issues, as anti-discrimination and anti-discrimination law, freedom of religion and belief, etc.

However, no broad and inclusive civil society monitoring initiative yet exists systematically to monitor the implementation of the UPR recommendations. Civil Society organisations need some start-up support to establish a sustainable monitoring mechanism on the UPR recommendatiopns. To note, that the Government of Moldova is open to a closer collaboration with the civil society, created and continues to strengthen the participatory mechanisms and the transparency of the decision-making process (for example, the Participation Council representing CSOs has been established to work jointly on planning and monitoring of the National Development Strategy (2008-11) and on „Moldova 2020” National Strategy formulation, implementation and monitoring.

The goals of the project:

•             To provide a regular platform for civil society engagement to implement the UPR recommendations;

•             To provide forums for discussions of difficult or challenging policy issues arising in the context of UPR implementation, as well as other key thematic discussions in this regard;

•             To provide journalists, policy-makers and others with an accessible point for regular and reliable information about the UPR as concerns implementation in Moldova;

•             To enhance UNDP work on achieving steady progress in the UPR implementation in Moldova.

Domain of action: The current proposed action  aims  to support UNDP work in mainstreaming human rights in Moldova, in particular via the UPR, by providing a grant to civil society to establish a UPR monitoring mechanism, and to begin public reporting on UPR implementation, working closely with all relevant stakeholders to monitor implementation of the UPR recommendations.   The proposed activities might include establishment of an internet portal/website for monitoring UPR recommendations in Moldova; organizing a training of participating NGOs in monitoring/reporting technics, regular reporting on the state of implementation of individual recommendations or clusters of recommendations; convening of UPR stakeholder meetings; as well as other related activities.
