Background

The “Support to Justice Sector Reform in Moldova” Project is implemented by UNDP Moldova with the support of the Democratic Governance Thematic Trust Fund (DGTTF) and in cooperation with the Ministry of Justice and the National Legal Aid Council.

This Project is based on two components. The first component (Ministry of Justice component) is designed to enhance capacities of the Ministry of Justice (MoJ) to develop, coordinate and implement justice sector reform measures. The project seeks to address urgent short-term capacity needs of MoJ.

The second component of the Project (Youth and Legal Aid component) is oriented to expedite achievement of MDGs in Moldova by mobilizing currently passive vulnerable youth around key social rights areas, including health, education, housing, social protection, work and employment. The project seeks to further strengthen the capacity of the National Legal Aid System Guaranteed by the State and empower vulnerable youth to use this framework in order to seek remedies in the national justice system.

Through a combination of different tools the Project will mobilize vulnerable youth around strategic advocacy themes and will seek to facilitate the use of the legal aid scheme for the protection of the fundamental social rights of the vulnerable youth. Making use of the publically funded legal aid scheme shall strengthen the access to justice for the most vulnerable social groups. There are, however, concerns about the quality of the free legal aid services. In addition, the beneficiaries of publicly funded legal aid have little incentive and capabilities to control the quality of the services provided.

In this respect, the Project will seek to set up a scheme for monitoring the quality of the provided legal aid with a particular focus on the vulnerable youth cases. Based on the results of this initiative, recommendations shall be drafted and submitted to the relevant national stakeholders to ensure sustainability of the legal aid quality monitoring effort.

In implementing the activities, the Project will focus on most vulnerable groups, including unemployed, women, Roma, young people living with HIV/AIDS, persons with disabilities, young migrants, stateless and refugees. The Project will also seek to ensure opportunities for equal participation of both women and men.

Scope of work

The objective of this consultancy service is as follows:

  • To develop a scheme for monitoring the quality of legal aid with a particular focus on cases involving vulnerable youth;
  • To perform on regular basis the quality monitoring exercise, covering all territorial offices of the National Legal Aid Council;
  • To draft and submit a set of recommendations concerning strengthening the legal aid quality monitoring system.

As part of the assignment, the incumbent shall assist the international mission on needs assessment of the National Legal Aid Council in Moldova with a focus on the quality of legal aid and participate in organizing a regional meeting in Chisinau on legal aid issues.

 Taking into account that it is a part-time consultancy position, it is expected that the incumbent will use 50% of the monthly working time to perform the assignment.

In order to achieve the objectives, the National Consultant shall:

  • Conduct a desk research as per Terms of Reference;
  • Set up the range of monitoring tools to be used/developed for the purpose of the assignment;
  • Establish dialogue and cooperate closely with the National Legal Aid Council and its territorial offices;
  • Perform, on a random basis, quality monitoring of the legal aid with a particular focus on cases involving vulnerable youth by using the existing and/or developed monitoring tools;
  • Conduct regular field visits and meet the representatives of the local stakeholders and service providers to collect necessary data for the assignment;
  • Organize and facilitate quarterly regional meetings and discussions focused on accessibility and quality of legal assistance, human rights issues faced by vulnerable youth, coordination and referral mechanisms, etc.
  • Assist the National Legal Aid Council in formulating indicators for measuring quality of legal aid;
  • Draft and submit recommendations to ensure sustainability of the legal aid quality monitoring effort, as well as to strengthen the access to justice for vulnerable youth;
  • Submit monthly activity reports;
  • Perform other assignment related tasks. 

Requirements for experience

I. Academic Qualifications:

  • University degree (preferably Master degree) in Law, Human Rights, Public Administration and/or other relevant fields.

II. Years of experience:

  • Proven experience (at least 3 years) in legal aid related field (practicing lawyer or lawyer apprentice is an asset);

III. Competencies:

  • Solid knowledge of legal aid system and quality assurance mechanisms;
  • Knowledge of legal profession;
  • Skills in analysing, generalizing, and systematizing information;
  • Strong leadership abilities and excellent (diplomatic) communication presentation skills, ability to facilitate discussions;
  • Ability to do desk research, collect and analyze data;
  • Excellent IT skills including word processing, database applications, presentation software and use of other relevant applications;
  • Successful experience in working with UN agencies is an asset;
  • Proficiency in written and spoken Romanian and Russian, knowledge of English is an asset;
  • Knowledge of one or more additional languages relevant for Moldova, including Bulgarian, Gaguzian, Romani, Ukrainian or sign language is an asset.

VI. Personal qualities:

  • responsibility, creativity, flexibility and punctuality.

  2. Letter of Intent containing:
  • Statement on candidate’s experience in the field of recruitment demonstrating his/her ability to fulfill the task;
  • Statement on the candidate’s aggregated financial offer (“aggregated financial offer” is the total sum of all financial claims of the candidate for accomplishment of the task).

Financial proposal

The financial proposal shall be in USD and specify monthly fee. Payments are based upon output, i.e. upon delivery of the services specified in the TOR.  In order to assist the requesting unit in the comparison of financial proposals, the financial proposal will include a breakdown of this lump sum amount.
