Background:

Moldova went through the UPR in October 2011.  UN, and UNDP in particular, actively participated in the process engaging with the relevant Government and non-Government bodies, providing advice and necessary support, as through the on-going Human Rights work, so through the UNCT Human Rights Adviser. The recommendations fall under the following general categories:

With the support of UN Moldova, civil society was actively engaged with the UPR process. The UN supported consultation meetings involving Government, civil society and the National Human Rights Institution, organised a number of training workshops and two study visits to Geneva (May 2010 and May 2011).  Civil society groups and Moldovan media attended the UPR Working Group session in October 2011, and a number of civil society actors returned to Geneva for the March 2012 Human Rights Council meeting that adopted the UPR Moldova Working Group report.  

Immediately after the UPR Working Group meeting in October 2011, UN Moldova supported a visit by the High Commissioner for Human Rights NaviPillay, the first such visit by a High Commissioner.   The Government decided to incorporate the received UPR recommendations to the already existing National Human Rights Action Plan 2011-2014 (NHRAP) in order to introduce specific actions for their implementation. For this purpose the corresponding amendments to the NHRAP were drafted. However, at the end of December 2012 the amendments were passed by the Parliament in a shortened version, and some of the UPR recommendations were not incorporated fully into the NHRAP.

The UPR recommendations are embedded in Moldova's new UN Partnerships Framework (UNPF) for 2013-2017; while the implementation of UPR recommendations is one of the core indicators for the UNPF Pillar 1 “Democratic Governance, Justice, Equality and Human Rights” (http://www.un.md/key_doc_pub/docs/UNPF%20Action%20Plan%202013-2017%20(En).pdf).  UN Moldova has clustered the recommendations thematically for use by policy-makers, civil society, journalists and others.

There are a number of strongly positioned Human Rights NGOs in Moldova, which have certain capacity and experience in dealing as with Human Rights issues in general, so with the particular rights. They are addressing gender equality, rights of children, of the persons with disabilities, of minorities, other vulnerable groups, a wide range of political, civil, social, economic and cultural rights. Civil society is active in submitting shadow reports to the UN Human Rights Treaty bodies.

A certain segment of these organisations became aware and trained on UPR issues benefitting from UNDP, OHCHR and other agencies support.Many Human Rights NGOs continue advocacy activities related to the implementation of the UPR recommendations, promoting the messages on the importance of their implementation for Moldova through mass-media and other means, in particular, on such sensitive, but important issues, as anti-discrimination and anti-discrimination law, freedom of religion and belief,gender equality, social rights, as well as on other issues.

However, no broad and inclusive civil society monitoring initiative yet exists systematically to monitor the implementation of the UPR recommendations. Civil Society organisations need further support to establish a sustainable monitoring mechanism on the UPR recommendations. To note, that the Government of Moldova is open to a closer collaboration with the civil society, created and continues to strengthen the participatory mechanisms and the transparency of the decision-making process. For this purposes a special National Human Rights Action Plan (NHRAP) Implementation Commission was set up in the form of meeting convened by Deputy Prime Minister for Social Affairs, bur civil society was not initially effectively included and the Commission is exploring the possibilities for a better CSOs involvement into the work. 

The goals of the project:

  • To provide a regular platform for civil society engagement in implementing the UPR recommendations;
  • To provide forums for discussions of difficult or challenging policy issues arising in the context of UPR implementation, as well as other key thematic discussions in this regard;
  • To provide journalists, policy-makers and others with an accessible point for regular and reliable information about the UPR as concerns implementation in Moldova;
  • To enhance UNDP work on achieving steady progress in the UPR implementation in Moldova.

Description of Action

The organisation that will win the grant’s competition is expected to carry out the following actions:

  • Action 1: To support and strengthen CSOs monitoring mechanisms of the UPR recommendations implementation by:
    • Supporting NGO’s sound engagement in monitoring and public reporting on UPR recommendations’ implementation through a close work with all relevant stakeholders. Applications may endeavor to monitor implementation of all UPR recommendations. In such cases, the NGO concerned should endeavor to demonstrate how it might reasonably do so. Alternate proposals might focus on several core UPR recommendations or clusters of recommendations.    Applications which would also include monitoring of discrimination in the health field are particularly encouraged. Applicants shouldjustify the selection of UPR recommendationsfor their monitoring and reporting;
    • Supporting the organisation of Technical Coordination Meetings on UPR implementation progress for the development agencies and diplomatic missions in Moldova with the participation of relevant stakeholders;
  • Action 2: To support the National Commission on the NHRAP Implementation in becoming more transparent and inclusive (for example, to include more NGOs’ representatives to take part and report to the Commission on the UPR recommendations’ implementation, to publish the agenda of the meetings in advance and to open it to public inputs, to organize thematic meetings, etc.) by:
    • Providing technical assistance and advice through the consultant to the Commission’s Secretariat, acting under the Ministry of Justice;
    • Identifying a feasible set up for an effective and representative oversight and coordination body for the implementation of international and regional human rights recommendations, taking into account existing elsewhere best practices.

These actions will contribute to the achievement of the UNPF Outcome 1.3 – “State bodies and other actors effectively promote and protect human rights, gender equality and non-discrimination, with particular attention to the marginalized and the vulnerable” and the Output 1.3.1 “Relevant public authorities exercise improved oversight of implementation of international human rights recommendations”. Support to the actions is provided by UNDP and by the United Nations Office of the High Commissioner for Human Rights (OHCHR).

Duration of the project: 8 months starting from 1stAugust 2013

Maximum grant amount: 12,000 USD

The application package should contain the following documents:

  • Copy of the registration certificate to prove that the organization is a registered legal entity;
  • Copy of the Statute of the organization;
  • CV of Project Manager;
  • A brief overview of the activities of the organization;
  • Other materials, which you find relevant for the application. 

The applications should be completed in English.

The budget of the project shall be provided in US $ and should be filled out as exemplified in the application form (attached below).
