UNDP provides support to renew the Legal Approximation Mechanism for the Republic of Moldova

Chisinau, April 26, 2011 – The new Concept of a New Legal Approximation Mechanism for the Republic of Moldova was presented within a public event to the representatives of several public institutions as Parliament, Ministry of Foreign Affairs and European Integration; Ministry of Justice, Centre for Legal Approximation; Ministry of Agriculture and Food Industry; Ministry of Economy and Ministry of Social Protection and Family.

The new mechanism has been designed taking in consideration current Moldovan relations with EU and the best legal approximation practices of the EU Member states and states aspiring for EU membership. It proposes competent solutions able to solve current difficulties related to the rulemaking process, legal approximation planning as well as ministries and agencies capacities compliance with the requirements of the harmonization process in the future. As well, the new mechanism reflects the conclusions of the Association Agreement with the EU, Agreement on Geographical Indications, Common Aviation Area Agreement with EU, Deep and Comprehensive Free Trade Area with the EU etc. The mechanism was developed by Juris Gromovs, an experienced Latvian Consultant on legal approximation.

This activity is related to the Governmental Commission for European Integration decision of February 3, 2011 on the necessity to improve current Moldovan legal approximation mechanism that is outdated and has been declared to be unable to ensure effective transposition and further implementation of the EU acquis within the negotiated deadlines.

Law approximation – an ongoing process that includes „adequate legal drafting“, „effective implementation“ and „enforcement of the harmonized national legislation“, is without doubts the most important condition for closer economic and political relations with EU and the most demanding task in the whole process of implementation of the Association Agreement.    

Both Mr. Oleg Efrim, the Deputy Minister of Justice and National Coordinator of the Legal Approximation mechanism and Ms. Natalia Gherman, Deputy Minister of Foreign Affairs and EU Integration and Moldovan Chief Negotiator of the Association Agreement with the EU, expressed their profound desire to see the Moldovan legal approximation mechanism properly adjusted, so that Republic of Moldova could timely fulfill with its obligations vis-a-vis EU.

The event was organized under the framework of “Building Institutional Capacity of the Ministry of Foreign Affairs and European Integration” project within the component: Capacity Development of the Ministry of Foreign Affairs and European Integration and the Negotiation Team in the process of the Association Agreement with European Union negotiation.
