Relations between the Republic of Moldova (RM) and EU formally started with the signing of the Partnership and Cooperation Agreement (PCA) in 1994 that entered into force in 1998. The PCA established the basic principles of cooperation between the RM and EU and was designed for 10 year period. Before formal expiring of the term, i.e. July 1st 2008, the Agreement is being prolonged automatically if none of the parties is requesting a formal cancelling of the agreement. Formally, the PCA agreement is the framework of relations between the RM and EU.
The Project will contract an International Consultant to provide consultancy services on legal approximation to the Ministry of Foreign Affairs and European Integration of the Republic of Moldova (further referred as Ministry).
Tasks and responsibilities
Analyze the existing Moldovan legal and institutional framework in legal approximation sector, studies and reports prepared by previous experts
If needed, organize and attend meetings and consultations related to legal approximation process, with relevant representatives of the Moldovan public Administration, other officials.
Suggest solutions and options for the improvement of the current legal approximation mechanism as regard existing Moldovan legal framework and institutional setting up (objectives, outputs, tasks distributions, inter-institutional cooperation, e.t.c.)
Develop a concept of a new law approximation mechanism (including law approximation planning) able to speed – up the process of transposition and effective implementation of the EU acquis. If the case, suggest a second option for the mechanism developed.
Deliver one public presentation of the concept of a new legal approximation mechanism and on its practical application (functioning).
Accordingly to the suggested law approximation mechanism, draft a new Government Decision on law approximation mechanism and provide specific proposals for subsequent changes in other relevant legislative acts.
Qualifications and skills required
Advanced degree in the area(s) of EU Law, Public Administration or similar field or equivalent working experience in the sector;
At least 7 years of professional experience in the area;
Experience in assisting governments with the development of similar mechanisms of legal approximation with EU acquis;
At list 3 years of experience as a public official responsible for EU policy coordination in a successful public administration;
Previous experience in Central and/or Eastern Europe with projects funded by international organizations;
Qualification and/or proven skills in project coordination, credibility in dealings with governmental officials, strong team leadership abilities and communication skills;
Excellent analytical and communication skills;
Fluency in written and spoken English, knowledge of Romanian or Russian will be a very strong advantage.
