National Consultant to Review the Draft Law on Parliamentary Civil Servant

Background |
The “Support to Parliamentary Development in Moldova” Project aims to enhance parliamentary efficiency in carrying out its functions and responsibilities thus contributing to viable democracy and open society in Moldova. The project adopts a comprehensive, long-term approach to parliamentary development including strengthening of the legislatures law-making, representation and oversight roles.
Following up the recommendations of the UNDP Functional Review Report (2005) and EU Twining Project, Parliament of Moldova initiated a Draft Law on parliament civil servant status. This draft was subject to Council of Europe expertise, which provided specific recommendations regarding the law content. During discussions on the draft law a set of suggestions and comments was formulated by Members of Parliament. These should be taken into account before the draft law will be finally adopted by Parliament.
In this context, UNDP is seeking to hire a national consultant to review the Draft Law on parliament civil servant status according to the Council of Europe expertise notification and the recommendations and suggestions formulated by Members of Parliament.

Duties and Responsibilities |
- Undertake a comprehensive desk review of the relevant national legal framework, relevant studies, researches, reports, EU/international best practices regarding parliament civil servant status;
- Get acquainted with previous functional reviews of Parliament (2005) and Council of Europe expertise notification (2010);
- Revise the Draft Law on parliament civil servant status, with emphasize on the appointment system, dismissal rules, promotion mechanisms, degree of discretion in decision making, renumeration system, social benefits;
- Undertake and facilitate interviews with the key stakeholders, Members of Parliament and with parliamentary staff;
- Other relevant tasks, as agreed with the counterparts.

Qualifications and skills required |
- University/Master Degree in Law, Public Administration, HR Management, social sciences or other relevant fields;
- Legal background and experience in drafting normative acts; Experience in comparative analysis, research, assessment on the implementation of the international legislation and policies;
- Extensive knowledge of Moldovan civil service system/specifics with emphasis on human resource management;
- At least 5 years of relevant professional experience;
- Knowledge of and working experience with Parliament or Government sector;
- Experience in participating in debates, round tables or other types of focused discussions;
- Proven experience in working with the international organizations (successful experience in working with UN agencies is an asset);
- Strong analytical and drafting skills;
- Ability to interpret results and provide practical recommendations;
- Initiative and resourcefulness;
- Computer proficiency, including knowledge of MS Office products (Word, Excel, Power Point);
- Extensive knowledge of Romanian and English languages.
