CONSULTANT: BORDER GUARD/POLICE MANAGEMENT SPECIALIST

Background

In June 2005 the Presidents of Moldova and Ukraine sent a joint letter to the EU requesting assistance for enhanced border management capacities, including the development of an international standard of border and customs control at the Republic of Moldova/Ukraine state border. The EU responded positively to this request and an EU Border Assistance Mission to Moldova and Ukraine was set-up which is based on a Memorandum of Understanding dated 7 October 2005 and signed between the European Commission, the Republic of Moldova and Ukraine. UNDP is the European Commission’s implementing partner in this endeavor. The initial duration of the EUBAM was 2 years until November 2007.  Its mandate has been extended until 30 November 2011.

Duties and Responsibilities

  • To advice and assist partner services to make the realizations of the border guard strategy sustainable.
  • To advice in the further implementation of the EU border policing standards (as also described in the Schengen acquis) in order to make those sustainable, e.g. to assist in developing procedures
  • To oversee and coordinate advices related to the border police and delivered by the Mission’s field personnel.
  • To elaborate by analogy a “handbook” of the EC border-related legislation and of best practices from EU Member States (including the Communitu Code on the rules governing the movement of persons across borders (so called Schengen Borders Code 562/2006EC of 15 March 2006) establishing rules for border control of persons crossing the EU’s external border, the Schengen Catalogue on External borders control , Return and Admission (best practices), Integrated Border Management Concept, etc.) which will guide the Mission’s field personnel daily work in the transmission of EU standards and practices to their Moldovan and Ukrainian partners.
  • To acquire and maintain a full view of the applicable Moldovan and Ukrainian border control legislation and practice.
  • To keep a close overview of the activities of related border police/guard reform projects from the EC and other donors.
  • To participate, upon request of the EC Delegation in Kiev and Chisinau, in the implementation of capacity building measures in other EC projects.
  • To implement and / or assist in the implementation of the EC technical assistance projects such as BOMMOLUK project.
  • By the end of each phase to make a Progress Report.
  • To make proposals for initiating and carrying out additional training for the border officials
  • To implement all other tasks assigned by the Head of Capacity Building Unit.

Competencies

  • Active (or recently retired) border police/border guard or other law enforcement official dealing with border related issues of an EU Member State or an EU Institution.
  • At least 8 years experience in a border police/border guard administration or a related law enforcement service dealing with border control and surveillance issues and the fight against cross-border crime and corruption of an EU Member State or an EU institution.
  • Extensive experience with, and knowledge of, both the common EU acquis communitaire related to border controls, and specific legislation and good/best practices of EU Member States, including a comparative and conceptual overview, as well as an understanding of customs issues through cooperative operational experience.
  • Experience in border management reform projects of candidate countries for EU accession, preferably in transition countries (possibly as a twinning adviser).

Required Skills and Experience

  • Master’s degree in law or other related field; in case of lower academic background, it shall be complemented with minimum 8 years of relevant working experience.
  • Very good command of written and spoken English.
  • Knowledge of Russian will be an asset.
  • Good drafting skills, familiarity with relevant IT software tools such as power point, etc.
  • Corresponding national security clearance.

UNDP will utilize a two-stage procedure for evaluating proposals, with evaluation of the technical proposal being completed prior to any price proposal being compared. Technical evaluation will be represented though the desk review of applications and further interview of short-listed candidates. 
 
A) The technical part is evaluated on the basis of its responsiveness to the Terms of Reference (TOR). Namely:

  • Educational background (10 – Master’s degree; 5-University degree; 5 - in case of lower academic background, it shall be complemented with minimum 8 years of relevant working experience.) – 10 points max;
  • National Security Clearance– 10 points max
  • Relevance of the experience and technical expertise – 10 points max
  • Language Skills (10 - both English and Russian; 8 – only Eng; 2 – only Russian) – 10 points max
  • Interview (30 - technical knowledge and experience s; 10 - communication/interpersonal skills; 10- motivation; 10 - creativity) - 60 points max
  • Total Score 100 points

UNDP will consider the price proposals only from the candidates that passed the minimum technical score of 70% of the obtainable score of 100 points in the evaluation of the technical proposals. Technical evaluation will be represented though a review of applications and further interview of short-listed candidates. The offer with highest scores obtained will receive a technically weighted score which will equal to 70. All other submissions that passed the 70% threshold will be evaluated as per below formula:

A = T/Thigh*(0.7), where:

T = The total technical score awarded to the bid
Thigh = The Technical Score achieved by the bid that was scored highest among all responsive bids

B) Financial evaluation:

UNDP will contact the successful candidates (those, who obtained 70% out of the 100 points during the technical evaluation) subject of providing the financial offer for proposed specific vacancy. The maximum number of points assigned to the financial proposal is allocated to the lowest price proposal and will equal to 30. All other price proposals will be evaluated and assigned points, as per below formula:

B = Clow /C*(0.3), where: C   = Evaluated bid price and Clow= The lowest of all evaluated bid prices among responsive bids

The proposal obtaining the overall cumulatively highest score after adding the score of the technical proposal and the financial proposal (A+B) will be considered as the most compliant offer and will be awarded a contract.
