A pool of 4 National Consultants to develop the baseline of the Moldovan situation on the area of torture and other cruel, inhuman or degrading treatment or punishment and related National Plan of Action - Torture Prevention Project

Background:

UNDP Moldova is seeking to contract a pool of 4 National Consultants to develop a “baseline document” on the situation on cases of torture and other cruel, inhuman or degrading treatment or punishment in places of detention, as well as a participatory National Action Plan on Prevention of Torture.

Tasks and responsibilities:

  • Analyzing the existing reports and related documents;
  • Compile the recommendations in one document/ baseline on the situation of incidence of torture/ ill-treatment with specification including according to category of institutions which recorded or may record incidences/claims of torture or other forms of cruel and/or degrading treatment or punishment;
  • Develop and submit the concept and content of the baseline document and NAPPT for discussion and approval by representatives of  NPM/CHR and UN/DP;
  • In cooperation with the project team, and taking account of ongoing plans and ongoing actions, provide the methodology and approach on process of NAPPT elaboration (including organization of workshops/round-tables, public hearings, meetings, etc);
  • Meet the representatives of the Ombudsman Institution / Centre for Human Rights and National Preventive Mechanism, Ministry of Justice, Ministry of Internal Affairs, specialized NGOs (Amnesty International Moldova, Rehabilitation Centre for Torture Victims, etc.), national mass media (the main newspapers and TV and radio channels) and International Organisations (Council of Europe, European Commission, OSCE, UNDP and other relevant members of the UN Country Team) etc, in order to present the situation/ problems identified, to discuss/ suggest concrete actions/ remedies to address the current situation, as well as to successfully implement the OPCAT provisions;
  • Develop the baseline document, using the best international practices and human-rights based approach;
  • Working on the basis of a draft Working Paper on international human rights issues related to administrative detention, undertake a comprehensive assessment of the current state-of-play of Moldovan law in the areas of detention and other areas related to arbitrary or abusive treatment in detention; finalize the baseline in Romanian. Note: It will be translated into English to be consulted with International Organisations;
  • Based on the findings from meetings and assessment, working closely with the Project Team and other relevant develop a draft NAPPT, including relevant chapters on issues concerning effective remedy and adequate accountability for cases of torture and other forms of cruel and/or degrading treatment or punishment, situation analysis, objectives, priority actions, timeframe, responsible parties, partners, funding sources, monitoring and evaluation indicators and plan;
  • Facilitate a dynamic series of roundtable workshops addressing thematic issues toward the NAPPT; collect the feedback and recommendations for improvement to be incorporated in the final draft NAPPT;
  • Incorporate the recommendations and suggestions of NAPPT improvement and submit the final draft to the Centre for Human Rights/ National Preventive Mechanism, UN/DP and other relevant counterparts. The document should be submitted in Romanian;
  • Present the final version of NAPPT to CHR/ NPM/ UNDP and other relevant counterparts for further approval;
  • Other tasks, as required.

Qualifications and skills required:

  • University degree in law, political sciences, social sciences or other relevant fields;
  • At least 3 years of proven professional experience in dealing with Human Rights international and national legislation, standards;
  • Extensive experience in comparative analysis, research, monitoring, assessment/evaluations on the implementation of the international human rights commitments by Moldovan authorities;
  • Extensive knowledge about human rights observance in Moldova and requirements of the UN/EU treaty bodies, as well as implications of relevant counterparts (Government, NGOs, UN agencies, donor community);
  • Familiarity with the UN Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (CAT) and the Optional Protocol to the CAP (OPCAT) and other relevant field documents;
  • Experience in participating in debates, round tables or other types of focused discussions;
  • Proven experience in working with the international organizations (successful experience in working with UN agencies is an asset);
  • Advanced ability to analyze, generalize and draft comprehensive reports with accurate information and qualitative recommendations;
  • Excellent (diplomatic) communication presentation skills, ability to facilitate discussions;
  • Excellent self-organisation abilities;
  • Ability to work in a team;
  • Proven PC skills, ability to use the Internet;
  • Extensive knowledge of Romanian and Russian languages, good command of English. Working knowledge of French is desirable.
