LAW OF THE REPUBLIC OF MOLDOVA
On Migration

Nr. 1518-XV, 06.12.2002

Article 9. Competence of Other Public Governance Bodies

(1)  Central public governance bodies, within their competence in the area of migration:

a)         foster promotion and implementation of the state migration policy in international legal relations;

b)         register and checks documents of foreign citizens and persons without citizenship, who want to immigrate to the Republic of Moldova, and issue entrance visas;

c)         protect through diplomatic services interests of citizens of the Republic of Moldova, who are outside of Moldova;

d)         suppress illegal migration and trafficking in human beings and take measures aimed at preventing them;

e)         deport and extradite, if necessary, foreign citizens and persons without citizenship, and take other measures stipulated in the legislation;

f)         identify persons connected to international terrorist organizations, trafficking in human beings, trade in arms, drugs, etc. and take measures prohibiting their entrance or deport such people from the country;

g)         verify information on persons who want to immigrate to the country;

h)         study demand in the internal labor market for use of foreign labor force;

i)         issue residence permits to foreign citizens or persons without citizenship on the basis of decisions of the Department of Migration;

j)         develop computerized information system on migration of the population;

k)         ensure control over the state border check-points, and ensure registration of persons who cross the state border;

l)         enter in the integrated information system data on persons who crossed the state border.

(2)  For the purposes of promotion and efficient implementation of the state migration policy the Ministry of Foreign Affairs, Ministry of Internal Affairs, Department of Frontier Troops, Department of Information Technologies, local governance bodies, law enforcement, tax bodies, enterprises, institutions, and organizations with any organizational-legal form have to inform the Department of Migration within ten-day period in the following manner:

a)         The Ministry of Foreign Affairs – on issued entrance visas;

b)         The Department of Frontier Troops – on foreign citizens, persons without citizenship and citizens of the Republic of Moldova, who entered the country or left the country, or who were prohibited from entering or leaving the country;

c)         The Department of Information Technologies – on changes that occurred in the family status of the immigrant or refugee, on registration of economic entities with participation of foreign citizens, as well as on identification documents issued to immigrants and refugees or on those cancelled;

d)         Local public governance bodies – on pre-schedule departure of an immigrant from their relevant territories;

e)         The Ministry of Internal Affairs, the Ministry of Justice, the General Prosecutor’s Office, Information and Security Service – on breaches committed by immigrants, persons seeking asylum and refugees, as well as on decisions of judicial bodies related to depriving them of their parental rights;

f)         Tax bodies – on cases of violations of the tax legislation by physical persons and legal entities managed by foreign citizens;

g)         Enterprises, institutions, and organizations of any organizational-legal form – on termination of individual labor agreements concluded with immigrants or on termination of labor relations with an immigrant due to his death, missing or him being declared as a deceased;

h)         State and private educational institutions and scientific-research institutes – on completion or suspension of studies or scientific research, on transfer to other educational institutions, institutes, enterprises, organizations, or on expulsion of foreign pupils, students, residents, doctoral and post-doctoral students.

(3)  Within 10 days the Department of Migration informs the Ministry of Internal Affairs and the Department of Information Technologies on abrogation of the period of validity of an immigration certificate, labor permit, and document identifying the personality of a refugee.
